Schmidt LLC Reaches Settlement for Client CSB-System International, Inc. in Patent Dispute Against SAP America, Inc

March 2013: On March 11, 2013, CSB-System International Inc. (“Licensor”) and SAP America, Inc. and its German parent, SAP AG (collectively, “SAP”), entered into a Patent License and Settlement Agreement (the “Agreement”) to globally settle all existing patent litigations between the companies. Under the terms of the Agreement, Licensor will license to SAP its U.S. patent no. 5,631,953 (the “’953 patent”) and all foreign patents and patent applications that claim the same priority as the ‘953 patent, in exchange for a one-time cash payment.

Schmidt LLC Wins for Plaintiff CSB-System International its Summary Judgment Motion of No Inequitable Conduct against SAP America

May 2012: Defendant SAP alleged as one of its defenses that CSB had obtained its patent-in-suit through inequitable conduct. CSB filed the present summary judgment motion of no inequitable conduct to have SAP’s defense eliminated and the Court sided with Schmidt LLC’s client.

Court Decision on SAP’s Summary Judgment Motion on Non-Infringement Allows Schmidt LLC’s Client CSB-System International to Advance to Jury Trial in June 2012

April 2012: In its motion, SAP asserts that CSB’s infringement cause of action fails under both a literal infringement theory and a doctrine of equivalence theory. While granting SAP’s motion on literal infringement, the Court denied SAP’s motion as to infringement under the doctrine of equivalents because infringement under the doctrine of equivalents requires an intensely factual inquiry. Thus, the Court left this issue “for full development at trial before a jury.” Consequently, this case will advance to a jury trial scheduled to take place in June 2012.

Schmidt LLC Defeats SAP America’s Summary Judgment Motion on Invalidity for Plaintiff CSB-System International

March 2012: The technology in this case concerns circuit arrangements of hardware and software that allow the integration of speech (telephone systems) with data systems. In its summary judgment motion on invalidity, Defendant SAP asserted that each claim of CSB’s patent-in-suit is invalid for allegedly having claimed both an apparatus and a method in a single claim. The Court disagreed and granted summary judgment in Plaintiff CSB's favor upholding the patent-in-suit. In so finding that the claims of the patent-in-suit were valid the Court ruled that each claim was limited to an apparatus with certain functional limitations and that such functional limitations were clearly tied to a specific structure and were not independent claim limitations.
